These Terms of Service ("Terms") govern access to and use of the SafePouch web application at mysafepouch.com (the "Service"), operated by Win Elements LLC ("Win Elements," "we," "us"). By accessing or using the Service, you and the school or district you represent ("School") agree to these Terms.
The Service allows authorized School staff to manage Safe Pouch® inventory, record pouch assignments and loaner checkouts, and document student interventions. The Service is provided to Schools for educational-operations use only.
Accounts are created for School staff by the School's designated administrator or by Win Elements at the School's direction. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend accounts that present a security risk.
Information the School enters into the Service — including student roster information and intervention records ("School Data") — belongs to the School. Win Elements processes School Data solely to provide the Service, as described in our Privacy Policy. The School is responsible for ensuring it has the authority to enter School Data into the Service and for the accuracy of that data.
You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorized access to the Service or another school's data; (c) interfere with or disrupt the Service; (d) resell or sublicense the Service; or (e) use the Service to store data unrelated to its purpose.
The Service, including its software, design, and content, is owned by Win Elements LLC and protected by copyright, trademark, and patent law. Safe Pouch® is a registered trademark of Win Elements LLC. See our Copyright notice. These Terms grant no rights other than the limited right to use the Service.
We work to keep the Service available and to back up School Data regularly, but the Service is provided "as is" and "as available" without warranties of any kind, express or implied. We may modify or discontinue features with reasonable notice to Schools.
To the maximum extent permitted by law, Win Elements LLC shall not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of data, arising from use of the Service. Our total liability for any claim relating to the Service shall not exceed the amounts paid by the School for the Service in the twelve months preceding the claim.
A School may stop using the Service at any time and may request export or deletion of its School Data. We may suspend or terminate access for material breach of these Terms.
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Venue for any dispute shall be the state or federal courts located in Riverside County, California.
